Terms of Service
Last updated: [date]
These terms explain how businesses can use Guestfix: accounts, the free trial, billing, your data and what each of us is responsible for. How we handle personal data is explained in our Privacy Policy.
Who we are and these terms
Guestfix Sh.P.K. ("Guestfix", "we", "us") makes Guestfix, a cloud property management system for hotels, and runs this website. Our registered address is [registered address], and our business registration number (NUIS) is [NUIS].
These terms are an agreement between Guestfix and the business that signs up for Guestfix ("you", "the customer"). The person who accepts them confirms that they are allowed to do so for that business. Guestfix is a service for businesses, not for consumers.
Accounts and users
You can add your staff as users of your Guestfix account and choose what each of them can see and do.
- Keep your account details accurate and up to date.
- Each user should have their own login. Keep passwords private and do not share accounts.
- You are responsible for what happens under your account, including what your users do, and for removing users who should no longer have access.
- Tell us straight away at [support email] if you think someone has used your account without permission.
The free trial
New customers can try Guestfix free for 14 days. There is no setup fee. At the end of the trial you can choose a plan to keep using Guestfix. If you do not, your account is paused, and we keep your data for [number] days in case you decide to continue.
Plans, billing and renewal
Guestfix is sold by subscription. You choose a plan (Standard or Pro) and pay monthly or yearly.
- Prices are shown in euros and do not include VAT, which is added where it applies.
- Subscriptions are billed in advance for each monthly or yearly period.
- Your subscription renews automatically at the end of each period until you cancel it.
- If you change plan, the new price applies from [the change / your next billing period].
- We may change our prices. We will tell you at least [number] days before a new price applies, and it will apply from your next renewal.
- If a payment fails, we will let you know. If it is still unpaid after [number] days, we may suspend your account until it is paid.
Cancellation and refunds
You can cancel at any time from your account or by writing to [support email]. Cancellation takes effect at the end of the period you have already paid for, and you can keep using Guestfix until then.
We do not refund fees for part of a billing period, unless the law requires it or we agree otherwise in writing.
Acceptable use
Use Guestfix only for running your accommodation business, and in line with the law. You must not:
- use Guestfix for anything illegal, fraudulent or harmful
- upload viruses or other harmful code, or try to break or overload the service
- try to access accounts, data or parts of the service you are not allowed to
- copy, resell or rent out Guestfix, or use it to build a competing product
- send spam or messages your guests have not agreed to receive
Your data
The data you and your users put into Guestfix, including your guests’ details and bookings, belongs to you.
- We use your data only to provide and support the service, as set out in our Privacy Policy and our data processing agreement with you.
- For your guests’ personal data, you are the controller and we are your processor. You are responsible for having a legal basis to collect it and for telling your guests how it is used.
- You can ask us for an export of your data at any time while your account is open, and for [number] days after it ends.
- After that, we delete your data within [number] days, unless the law requires us to keep it.
Third-party services
Guestfix connects to services run by other companies, such as booking sites, payment providers (for example Stripe or your bank) and fiscal providers. When you connect one of them:
- your use of that service is covered by its own terms, which are between you and that company
- we send it the data needed for the connection to work
- we are not responsible for how it works, what it charges, or if it changes or stops
Availability and support
We make reasonable efforts to keep Guestfix available and working well. Sometimes we need to carry out maintenance; we try to do this at quiet times and to give notice of planned work. The service may also be interrupted by things outside our control, such as failures of internet providers or third-party services.
We offer support by email at [support email] and through the channels listed for your plan, during [support hours].
Changes to the service and these terms
We keep improving Guestfix, so features may change over time. We will not remove an important feature you rely on without telling you first.
We may update these terms. We will post the new version on this page with a new date, and tell account holders by email at least [number] days before important changes take effect. If you do not agree to the changes, you can cancel before they apply.
Intellectual property
Guestfix, including its software, design and name, belongs to us and our licensors. While your subscription is active, we give you a right to use Guestfix for your business under these terms. You keep all rights to your own data and content. If you send us feedback or ideas, we may use them to improve Guestfix.
Confidentiality
Each of us may see information about the other that is not public, such as business details, prices or data. We will each keep it confidential and use it only for the purpose of this agreement, unless it is already public or the law requires it to be disclosed.
Warranties and liability
We provide Guestfix with reasonable care and skill. Apart from that, Guestfix is provided "as is", and we do not promise that it will be free of errors or interruptions, or that it suits every purpose.
- Neither of us is liable for indirect or consequential losses, such as lost profits, lost bookings or lost business.
- Our total liability under these terms is limited to the fees you paid us in the [12] months before the event that caused the claim.
- Nothing in these terms limits liability that cannot be limited by law, for example for fraud.
Suspension and termination
You can end your subscription at any time by cancelling it, as described above.
- We may suspend your account if you do not pay, if you seriously break these terms, or if we need to protect the service or other customers. Where we can, we will tell you first and give you time to fix the problem.
- We may end the agreement if a serious breach is not fixed within [number] days of our notice.
- When the agreement ends, your access stops, and your data is handled as described under "Your data".
Governing law and disputes
These terms are governed by the laws of the Republic of Albania. If we disagree about something, we will first try to resolve it by talking to each other. If we cannot, the courts of [Tirana] will decide.
